These Terms of Service ("Terms") govern your use of the CODcheck application for Shopify (the "App") and the website at codcheck.ro (together, the "Service"), operated by CODcheck ("CODcheck", "we", "us"). By installing or using the App, you ("you", the "Merchant") agree to these Terms. If you do not agree, do not install or use the App.
CODcheck helps Shopify merchants reduce cash-on-delivery (COD) fraud by scoring orders for refusal/fraud risk, optionally hiding cash-on-delivery at checkout or holding risky orders for review, and — where the Merchant opts in — contributing anonymised refusal signals to a shared anti-fraud network. Features may change, improve or be discontinued over time.
The App is provided for business use by Shopify merchants. You must have a valid Shopify store and authority to install apps on it. Authentication is handled through Shopify; you are responsible for your Shopify account and for all activity that occurs through your store's use of the App.
CODcheck's risk scores, verdicts and network signals are probabilistic estimates intended to assist your decisions. They are not a guarantee that any order is or is not fraudulent. You remain solely responsible for deciding whether to fulfil, hold or cancel an order. CODcheck is not liable for orders wrongly flagged (false positives) or not flagged (false negatives), or for any fulfilment, shipping or chargeback outcome.
If you opt in, you grant CODcheck the right to include anonymised, hashed failure signals from your store in the shared network and to make matching hashed signals from other participating stores available to you, for the purpose of fraud prevention. Only irreversible hashes are shared — never names, phone numbers, emails or addresses. You may leave the network at any time from the App's settings.
You may not: (a) copy, resell, sublicense or redistribute the Service; (b) reverse engineer, decompile or attempt to extract source code except to the extent permitted by law; (c) interfere with or disrupt the Service, or attempt to access it by means other than the documented interfaces; (d) use the Service to build a competing product; or (e) use it in violation of any law or third-party right.
The Service, including its software, models, scoring logic, design and content, is owned by CODcheck and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the App for your store while these Terms are in effect. All rights not expressly granted are reserved.
Our handling of personal data is described in our Privacy Policy, and our processing of your customers' data on your behalf is governed by our Data Processing Agreement, which are incorporated into these Terms.
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect or prevent all fraud.
To the maximum extent permitted by law, CODcheck will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, goods, data or goodwill, arising out of or relating to the Service. Our total aggregate liability for any claim relating to the Service will not exceed the amounts you paid to CODcheck through Shopify for the App in the three (3) months preceding the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.
You agree to indemnify and hold CODcheck harmless from claims, damages and expenses arising from your use of the Service in breach of these Terms or of applicable law, including your fulfilment decisions and your obligations to your own customers.
These Terms apply for as long as the App is installed. You may end them at any time by uninstalling the App. We may suspend or terminate access for breach of these Terms or where required by law or by Shopify. On termination, your right to use the App ends; data handling on termination is described in the Privacy Policy and DPA.
We may update these Terms as the Service evolves. Material changes will be reflected by a new version number and effective date above. Continued use of the App after a change takes effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Romania and the European Union, without regard to conflict-of-laws rules, and the courts competent for CODcheck's registered seat have jurisdiction, unless mandatory consumer or local law provides otherwise.
